Terms of Service

Agreement to Terms

By accessing or using InfluTo (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Service Description

InfluTo is an affiliate marketing platform connecting mobile app developers with influencers.

For Developers: Create campaigns, set commission rates, track conversions, and manage influencer payouts.

For Influencers: Join campaigns, share referral links, earn commissions, and receive automatic payouts.

Account Registration

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not create multiple accounts or share credentials
• We reserve the right to suspend or terminate accounts for violations

Platform Fees & Commissions

For Developers

• Platform Fee: 10% of commissions paid to influencers
• commission: You set the commission rate (percentage or flat amount)
• Total Cost: Commission + 10% platform fee per conversion
• Payment: Pre-fund your wallet via Stripe
• No Monthly Fees: You only pay when conversions happen

For Influencers

• Free to Join: No fees charged to influencers
• commission: Earn the commission rate set by the developer
• Recurring: Earn every month as long as referrals stay subscribed
• Minimum Payout: $20 minimum to receive payout
• Schedule: Automatic monthly payouts on the 1st
• Processing: Funds arrive via Stripe Connect in 2-7 business days

Wallet & Payments

• Developers must pre-fund their wallet to pay commissions
• Funds are held in escrow and released for payouts monthly
• Low balance alerts are sent when funds may run out
• Unused wallet funds can be withdrawn (minus processing fees)
• We are not responsible for failed payouts due to insufficient funds
• All payments are processed securely through Stripe

Commission & Payout Terms

• Commissions are calculated based on subscription revenue from RevenueCat webhooks
• 72-hour attribution window for referral tracking
• Commissions are reserved immediately when conversions occur
• Payouts are processed monthly, typically on the 1st
• Refunds within 14 days may result in commission clawback
• Disputed charges may result in commission adjustment or reversal

Attribution & Tracking

• We use IP address and device fingerprinting for attribution
• Attribution window is 72 hours from initial click
• We cannot guarantee 100% attribution accuracy
• Developers can review and manually adjust attributions
• Fraudulent activity will result in immediate account termination

Refunds & Clawbacks

• If a user gets a refund from the app store, the associated commission may be clawed back
• Refunds processed within 14 days of purchase result in full commission reversal
• Chargebacks may result in additional fees passed to the developer
• Influencers will not be penalized for legitimate user refunds beyond the specific transaction

Account Termination

• Either party may terminate their account at any time
• Upon termination, pending payouts will be processed as normal
• We may terminate accounts immediately for:
  • Terms of Service violations
  • Fraudulent activity
  • Abusive behavior toward other users

Prohibited Activities

You may not:

• Use the Service for any illegal purpose
• Attempt to game or manipulate the attribution system
• Create fake accounts or conversions
• Use automated bots or scripts
• Violate intellectual property rights
• Harass, abuse, or threaten other users
• Reverse engineer or attempt to access source code

Intellectual Property

The Service, including its original content, features, and functionality, is owned by InfluTo s.r.o. and protected by international copyright, trademark, and other intellectual property laws.

Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the last 12 months
• We are not responsible for third-party actions (Stripe, RevenueCat, etc.)
• We do not guarantee uninterrupted or error-free service

Modifications to Terms

We may modify these terms at any time. Material changes will be communicated via email or platform notification.

Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of Prague, Czech Republic.
