Terms of Service

By accessing or using InfluTo (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

InfluTo is an affiliate marketing platform connecting mobile app developers with influencers.

For Developers: Create campaigns, set commission rates, track conversions, and manage influencer payouts.

For Influencers: Join campaigns, share referral links, earn commissions, and receive automatic payouts.

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not create multiple accounts or share credentials
• We reserve the right to suspend or terminate accounts for violations

For Developers

• Platform Fee: 10% of gross attributed transaction revenue, charged in addition to the influencer commission
• Commission: You set the commission rate as a percentage of each verified purchase
• Total Cost: Influencer commission + platform fee (10% of the transaction amount) per conversion
• Payment: Pre-fund your wallet via Stripe
• No Monthly Fees: You only pay when conversions happen

For Influencers

• Free to Join: No fees charged to influencers
• Commission: Earn the commission rate set by the developer
• Recurring: Earn every month as long as referrals stay subscribed
• Minimum Payout: $20 minimum to receive payout
• Schedule: Automatic monthly payouts on the 1st
• Processing: Funds are sent through Stripe Connect; arrival depends on Stripe and the receiving bank

• Developers must pre-fund their wallet to pay commissions
• Your prepaid balance funds creator commissions and platform fees; creator payouts run monthly
• If the wallet can no longer cover new commissions, campaigns pause automatically; purchases in the following 72 hours still count
• Unused wallet funds can be withdrawn (minus processing fees)
• We are not responsible for failed payouts due to insufficient funds
• All payments are processed securely through Stripe

• Commissions are calculated on purchases verified with the App Store or Google Play, through RevenueCat or directly with the stores
• 72-hour attribution window for referral tracking
• Commissions are reserved immediately when conversions occur; milestone bonuses are committed when approved and deducted at the monthly payout run
• Payouts are processed monthly, typically on the 1st
• Refunded purchases are reversed; if the commission was already paid, it is deducted from the influencer's next payout
• Disputed charges may result in commission adjustment or reversal

InfluTo acts solely as a technical intermediary and payment facilitator between developers and influencers. This section clarifies the flow of funds and each party's tax responsibilities:

• InfluTo facilitates the affiliate arrangement and the related payments, but is not itself a party to the commission agreement, which exists directly between the developer and the influencer.
• A developer's prepaid balance is an advance payment for InfluTo's services. It funds creator commissions and platform fees for the developer's campaigns; the unused balance is refundable. InfluTo's revenue is the platform fee only.
• Influencer commissions are paid through Stripe Connect into each influencer's own connected Stripe account, of which the influencer is the recipient and account holder.
• Each party is responsible for its own taxes. Influencers are solely responsible for declaring and paying any tax due on commissions they receive; developers are responsible for the tax treatment of their own business.
• InfluTo is not a tax-withholding agent and does not issue tax forms (such as IRS Form 1099 or W-8BEN) on behalf of influencers. Identity verification and tax reporting for payout accounts are handled by the payment processor (Stripe) and the influencer.
• InfluTo provides a receipt for each deposit and a monthly statement of fees and commissions. VAT invoices for platform fees are issued in accordance with applicable law.

• Referrals are attributed through referral codes and links; as a fallback, an install can be matched to a recent click from the same network (IP address) within the attribution window
• Attribution window is 72 hours from initial click
• We cannot guarantee 100% attribution accuracy
• Developers can see every attributed install and purchase in their dashboard
• Fraudulent activity will result in immediate account termination

• If a user gets a refund from the app store, the associated commission may be clawed back
• A refunded purchase reverses its commission in full, whenever the refund happens
• Chargebacks may result in additional fees passed to the developer
• Influencers will not be penalized for legitimate user refunds beyond the specific transaction

• Either party may terminate their account at any time
• Upon termination, pending payouts will be processed as normal
• We may terminate accounts immediately for:
  • Terms of Service violations
  • Fraudulent activity
  • Abusive behavior toward other users

You may not:

• Use the Service for any illegal purpose
• Attempt to game or manipulate the attribution system
• Create fake accounts or conversions
• Use automated bots or scripts
• Violate intellectual property rights
• Harass, abuse, or threaten other users
• Reverse engineer or attempt to access source code

The Service, including its original content, features, and functionality, is owned by Jan Horák, the operator of InfluTo, and protected by international copyright, trademark, and other intellectual property laws.

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the last 12 months
• We are not responsible for third-party actions (Stripe, RevenueCat, etc.)
• We do not guarantee uninterrupted or error-free service

We may modify these terms at any time. Material changes will be communicated via email or platform notification.

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of Prague, Czech Republic.
